2. The petitioner is in custody since 08.08.2023 in connection with Patori Samastipur Excise P.S. Case No. 049/2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 33 litres of countrymade liquor has been recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to politics. He further submits that the alleged liquor has been recovered from the house which is in joint possession of the family.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. In view of the aforementioned facts and circumstances and also the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court2, Samastipur, in connection with Patori Samastipur Excise P.S. Case No. 049/2023.

7. The petitioner is directed to mark his attendance before the Dalsinghsarai Police Station on the first Sunday of every month.
