2. The petitioner seeks bail in connection with Sessions Trial No. 329 of 2019 arising out of Mohammadpur P.S. Case No. 50 of 2019 registered for the offence under Section 302/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are accused of killing the deceased.

4. The petitioner is in custody since 29.03.2019.

5. Learned counsel for the petitioner submits that though, the petitioner is the main assailant of the deceased but he is in custody for more than 6 years and 7 months. He further submits that the prosecution is delaying the trial as out of 13 charge-sheeted witnesses, only 5 witnesses have been examined.

6. Considering the period of custody and the delay in the trial, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 1st, Gopalganj/concerned Court below in connection with Sessions Trial No. 329 of 2019 arising out of Mohammadpur P.S. Case No. 50 of 2019.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
