JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner is in custody since 02.05.2017 in connection with Special Case No. 07 of 2012 registered under Sections 420, 409, 467, 468, 471, 34of the Indian Penal Code and Section 13(1)(d) of the Prevention of Corruption Act along with Section 120B of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner happens to be the doctor is innocent and has not committed any offence rather he has falsely been implicated in this case. In fact, the instant case has been lodged against one Dr. Uchit Lal Mandal, the then Civil Surgeon, Kaimur, who has already been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 27053 of 2012. The case of the petitioner stands of better footing to Dr. Uchit Lal

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance-1st, Patna in connection with Special Case No. 07 of 2012 arising out of Bhabhua P.S. Case No. 533 of 2011. (Arvind Srivastava, J) brajesh/- U T
