====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 376, 504, 506/34 of the Indian Penal Code.
3. As per F.I.R., on 04.05.2024 at about 11:30 PM, coaccused Sharwan Kumar knocked the door of informant and entered into her house and raped her. It is further alleged that
Patna High Court CR. MISC. No.69348 of 2024(2) dt.08-10-2024 2/3 co-accused Sharwan Kumar made video of the act and also demanded Rs. 20 lacs from informant for deletion of the said video. It is further alleged that when informant narrated the entire incident with her family members, these petitioners threatened to kill her.
4. Learned counsel for the petitioners submits that petitioner No. 1 is father, petitioner No. 2 is mother and petitioner Nos. 3 and 4 are brothers of co-accused Sharwan Kumar. Specific accusation is against co-accused Sharwan Kumar and these petitioners are only alleged to have threatened informant. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Danapur in connection with Paliganj P. S. Case No. 172 of 2024, subject to condition as laid down under Section
