The petitioner seeks bail in connection with Chainpur P.S. Case No.169 of 2019/G.R. No.894 of 2019 registered under Sections 25(1-b)a and 26 of the Arms Act. The accusation is that in course of police patrolling duty, one person started to flee away on seeing the police party but, on chase, he was apprehended, who disclosed his name as Chhote Lal Bind alias Chhotan Bind (petitioner). On search, he was found in possession of one loaded country made pistol and ten live cartridges.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is accused in nine
Patna High Court CR. MISC. No.77451 of 2019(2) dt.09-01-2020 2/2 other cases, as detailed in paragraph-3 to this application, due to that reason, the police got implicated the petitioner in the present case also, showing the aforesaid recovery from his possession. The petitioner is in custody since 04.05.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Kaimur at Bhabua, in connection with Chainpur P.S. Case No.169 of 2019/G.R. No.894 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
