The petitioner seeks anticipatory bail in Kartahan P.S. Case No.80 of 2016 instituted for the offences under Sections 341, 324, 307, 379, 354, 504 and 506 of the Indian Penal Code.

As per allegation petitioner along with accused persons have uprooted the brinjal plant from the field of the informant. The informant along with her family members came there and protested against the said illegal act. It has been alleged that petitioner no.1 has assaulted the informant with Hasua whereas petitioner no.2 has assaulted the grandson of the informant with Farsa.

Patna High Court Cr.Misc. No.27910 of 2017 (3) dt.13-07-2017 In such view of the matter, this Court is not inclined to enlarge the petitioners on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioners surrender before the court below within a period of three weeks, the court below will pass an order on its own merit without being prejudiced by the order passed by this Court.
