The petitioners, five in number, apprehend their arrest in a case under Sections 341, 323, 324, 307, 504, 354/34 of the Indian Penal Code.
The informant Budhni Devi made allegation that the petitioners assaulted the informant and others. It is submitted that there is a counter-version. Both sides are neighbours. Some dispute arose due to pathway. When the informant was milking her she-buffalo, Baidyanath Ram took her on the pathway and assaulted her with Farsa causing injury on her head. The police did not find the case true under Section 307 of the Indian Penal Code. The police submitted chargesheet under Sections 341, 323, 308,

No.16974 of 2016 (2) dt.13-05-2016 2/2 504, 354/34 IPC Considering the facts that there is a case and countercase and both sides sustained simple injuries, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S.K. Rai, Judicial Magistrate 1st Class, Jhanjharpur (Madhubani) in Laukahi P.S. Case No. 125/2013, corresponding to G.R. No. 1522/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
