JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Dehri (Twon) P.S. Case No. 1 of 2017, registered under Section 414 of the Indian Penal Code.

The accusation is that on receiving secret information about moving of a boy with stolen motorcycle, Police personnel started checking of the vehicle. At that time, one person was seen moving with a motorcycle in very high speed. On chase, bike rider was apprehended, who disclosed his name as Shiv Kumar Paswan (Petitioner). The petitioner failed to produce any paper regarding ownership of the vehicle.

Learned counsel for the petitioner submits that the petitioner, who was passing through road, was apprehended mere on

Patna High Court Cr.Misc. No.27689 of 2017 (2) dt.12-07-2017 2/2 suspicion showing the recovery of stolen motorcycle from his possession. The petitioner has no criminal antecedent is in custody since 02.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Dehrionsone, Rohtas in connection with Dehri (Town) P.S. Case No. 1 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
