Patna High Court CR. MISC. No.64601 of 2019(2) dt.16-10-2019 2/3 connection with Bhagwanpur P. S. Case No. 119 of 2019, disclosing offences under Sections 147, 148, 149, 323, 341, 447, 307, 379, 504, 506 of IPC.
At the very outset, it is submitted by the learned counsel for the petitioners that petitioners no.10 & 12 have been arrested. As such, he may be permitted to withdraw this application against these petitioners. In that view of the matter, this application stands dismissed as withdrawn against petitioners no.10 & 12.
As per F.I.R. allegation against the petitioners that they have entered into the house of the informant assaulted him and looted away the articles.
Submission of the learned counsel for the petitioners is that there is inordinate delay in lodging the F.I.R. There is case and counter case between the parties. Petitioners side have also lodged a case against the informant and others. Moreover, injuries are simple in nature, which will appear from Annexure 3 series.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioners, above named, except petitioners no.10 & 12, in the event of
Patna High Court CR. MISC. No.64601 of 2019(2) dt.16-10-2019 3/3 their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-V, Kaimur at Bhabhua, in connection with Bhagwanpur P. S. Case No. 119 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
