2. This is the 2nd attempt on behalf of the petitioner for regular bail in connection with Biraul P.S. Case No. 513 of 2022 registered for the offences punishable under Sections 399, 402, 414 of the IPC and under Sections 25(1-b)A, 26, 35 of the Arms Act.
3. Earlier the bail application of the petitioner was rejected by this Court vide Cr. Misc. No. 2546 of 2024 on 24.01.2024.
4. The petitioner is in jail since 31.12.2022. Not even a single prosecution witness has been examined in the present case.
5. Considering the period of custody and the delay in
Patna High Court CR. MISC. No.70904 of 2024(4) dt.04-04-2025 2/2 trial, this application for regular bail is allowed.
6. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-II, Benipur, Darbhanga/concerned Court below in connection with Biraul P.S. Case No. 513 of 2022 subject to condition that:- (i). The petitioner will mark his attendance at the Alinagar Police Station on every Sunday of each month and on every Wednesday of each month, he will mark his attendance at Biraul Police Station. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bond of the petitioner.
