The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 387, 447, 504, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has antecedent of one case and is a woman, and the informant alleges that she was married to Rajeev Ranjan and from the wedlock she had one son and daughter, it is next alleged that after the death of Rajeev Ranjan she performed second marriage with Om Darshi, it is next alleged that Om Darshi also died on 23.05.2021, it is further
Patna High Court CR. MISC. No.1665 of 2022(2) dt.04-08-2022 2/3 submitted that after the death of her second husband her sautan Kanchan Kumari (petitioner) along with Brij Darshi came at her gate at 07.00 P.M. and started abusing, it is next alleged that they took a V.I.P. brief case which contained 40 tola gold along with cash as detailed in the FIR. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that petitioner is legally wedded wife of Om Darshi and the informant never married Om Darshi, though she tried to get close with him, but after his death, in order to lay claim over his property, the present false case has been instituted.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below
