The petitioner apprehends his arrest in Amba P.S. Case No. 5 of 2017 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code, Section 40 of the Bihar Minor Mineral Concession Rule and Section 3 of Prevention of Damage of Public Property Act.

The two trucks bearing registration number WB37C4755 and JH09H-3351 were intercepted while they were carrying stone chips. It is alleged that the trucks were overloaded with stone chips and the drivers were not carrying papers. Learned counsel for the petitioner submits that the petitioner is the owner of the truck bearing number WB37C-4755. The driver of the truck was plying the truck on hire. The owner of

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Amba P.S.
