ANJANA MISHRA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/ 148/149/341/307/120(b) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that whatever be the nature of allegations, there is no specific allegation against the present petitioner. It has been submitted that there has been free firing resulting in the injury of one Arjun Ram. The informant who is said to be an eye-witness in this case which is in itself rather peculiar as none of the parties which have been involved in the free fight have come forward to register this case. Patna High Court Cr.Misc. No.27823 of 2017 (2) dt.12-07-2017 P2/2 submits that another similarly situated co-accused person who has also been named in the First Information Report, has been extended the privilege of anticipatory bail vide order dated 06.07.2017 passed in Cr. Misc. No. 28082 of 2017. In view of the aforementioned facts and circumstances of the case and there being no criminal history, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Bihiyan P.S. Case No. 20 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
