JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 409-C of 2016, disclosing offences under Sections 341, 323, 420 and 504 of IPC. Allegation against the petitioner is that he had cheated away Rs.60,000/- for the admission of daughter of the informant in V.A. Institute of Technology Management Institute, Jhajha and also taken original educational certificate along with Rs.4000/- for admission and Rs.5000/- for books and thereafter, given an Identity Card of Bodhwan Institute, Jhajha, Jamui. When the complainant demanded the money and educational certificate, he anyhow return the original certificate, but has not returned the money and assaulted the informant also. Patna High Court CR. MISC. No.58604 of 2019(2) dt.17-09-2019 2/3 petitioner is ready to return Rs.30,000/- to the complainant on condition that will be subject to final outcome of the case and that will not prejudice the defence of the petitioner. Heard learned APP also.

In such view of the matter, let the petitioner, above named, surrender before the learned court below within a period of four weeks from the date of receipt of certified copy of this order along with bank draft of Rs.30,000/- in the name of complainant. Once the aforesaid amount is deposited, the petitioner will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Jamui, in connection with Complaint Case No. 409-C of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

It is also made clear that the deposit of aforesaid amount will be subject to final outcome of the case and will not prejudice the defence of the petitioner.

It is also made clear that once any application is filed by the complainant that withdrawal of the same, the same shall be released in favour of the complainant on undertaking that he is to abide by any final outcome of the case.
