Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Dumra P.S. Case No. 157 of 2020 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
The learned counsel for the petitioner has submitted that the petitioner was granted anticipatory bail by the coordinate Bench of this Court in Cr. Misc. No. 38393 of 2020, but he could not surrender within the stipulated period of six weeks
Patna High Court CR. MISC. No.1310 of 2022(2) dt.01-06-2022 2/2 and meanwhile he was arrested. He has submitted further that the petitioner was not arrested at the spot, but his name was figured in the confessional statement of co-accused. Considering the above-mentioned facts and circumstances, the petitioner above-named is directed to be released on bail only after framing of the charge on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Dumra P.S. Case No.157 of 2020.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
