The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 308, 379, 504/34 of the Indian Penal Code. As per prosecution case, informant alleged that after one phone call made by daughter of co-accused Devendra Mandal, when he reached near his house, the petitioner along with co-accused assaulted him by means of Davia and Iron rod. It is further alleged that they also snatched having Rs. 15000/- one gold chain and finger ring of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

Patna High Court CR. MISC. No.62740 of 2022(2) dt.20-02-2023 2/2 falsely been implicated in this case due to dirty village politics. The specific allegation of assaulting by means of dabiya is against co-accused Devendra Mandal. As per the impugned order, the injuries sustained by injured are simple in nature except one injury. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 12.09.2022 Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manigachhi P.S. Case No. 66 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5, Darbhanga.
