JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,341,323,379 and 427 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the petitioners and four unknown persons committed theft in the house of the informant, co accused Rahul Mandal snatched Rs.3300/- and mobile from Angad Das. Co accused Bugo Mandal assaulted Diwakar Das with lathi and snatched silver chain. All the accused persons abused the informant by calling his caste name.

No.17450 of 2015 (2) dt.14-05-2015 2/2 It is submitted by the learned counsel for the petitioners that neither there is specific accusation of assault against the petitioners or committing theft nor abused the informant. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

It is submitted by learned Special P.P. that the petitioners were also members of mob.

Considering the fact that the accusation is not specific against these petitioners, let them be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 247 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
