2. The petitioner superannuated from the post of Head Master, Nationalized Middle School, Dhabhi (Laukahi), Madhubani on 28.02.2023. On being aggrieved with the inaction of the respondents in not extending the GPF amount alongwith the statutory interest, the petitioner approached this Court by filing the present writ petition.

3. Learned Advocate for the petitioner contended that though during the pendency of the writ petition, the petitioner has been allowed an amount of Rs. 12,56,447/-, however, it has

MDB/2025/FP/1 dated 25.01.2025 and thereafter the amount has been credited in the account of the petitioner. Notwithstanding the delay in making payment of admissible GPF amount, the petitioner has not been extended upto date interest for the period on which the petitioner superannuated and till the payment has been made. It is also contended that the petitioner has not been paid, any interest over the amount of G.P.F. for the period of July, 2018 to July, 2019.

On the other hand, learned Advocate for the State authorities referring to the averments made in the counter affidavit filed on behalf of respondent no. 6 submitted that after receipt of G.P.F. statement from the department, a calculation has been made with upto date interest and having obtained the approval by the District Magistrate, Madhubani, an authority for Rs. 12,56,447/- has been issued in favour of the petitioner.

Having considered the submissions set forth by learned Advocate for the respective parties, this Court deems it fit and proper to dispose off the writ petition, however, with a liberty to the petitioner to file an appropriate application before the District Provident Fund Officer, Madhubani preferably within a period of 4 weeks' from today regarding his claim for

Patna High Court CWJC No.14330 of 2024(2) dt.23-07-2025 3/3 interest. In case such an application is filed, the same shall be considered and disposed off by a reasoned and speaking order.

6. Suffice it to observe in case the petitioner finds entitled for interest over the delayed payment, the same shall be accorded to the petitioner within a further period of 8 weeks. (Harish Kumar, J) supratim/- U
