2. The petitioner has prayed for bail in connection with Kalyanpur P.S. Case No. 327 of 2022 registered for the offence punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution is that three persons on a bike intercepted the informant and on the point of pistol took away the bag of the informant containing Rs. 7,05,000/-.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that the F.I.R. was lodged against unknown miscreants. During course of investigation, one Rakesh Kumar was apprehended. He has given his confessional statement and he

It has also been submitted that nothing has been recovered from the possession of this petitioner. It has also been submitted that said Rakesh Kumar has been granted bail by learned Co-ordinate Bench vide order dated 22.02.2024 in Cr. Misc. No. 10588 of 2024. It has also been submitted that the case of this petitioner stands on better footing than that of Rakesh Kumar. Petitioner is languishing in judicial custody since 08.04.2025.

5. Learned APP appearing for the State has vehemently opposed the the application for bail and has submitted that petitioner is having criminal antecedent of six cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Samastipur in connection with Kalyanpur P.S. Case No. 327 of 2022.
