The petitioners are apprehending their arrest in connection with Punpun P.S.Case no.185 of 2019 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 338, 427, 353, 379, 504, 506 and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per FIR, the police arrested one person namely Vigan Manjhi and there is recovery of liquor from his house but on the abatement of one Manoj Kumar Ravidas, petitioners and other accused persons attacked the police party in order to make free Vigan Manjhi.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.60146 of 2019(2) dt.23-09-2019 2/2 that except general and omnibus allegation, nothing specific has been attributed against them as well as they have no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Patna in connection with Punpun P.S.Case No.185 of 2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
