The petitioner apprehends his arrest in Complaint Case No. 1190/2014 filed for offence under Sections 323, 341, 420, 467, 468, 471, 504/34 of the Indian Penal Code. Mosmt. Lalmuni Devi alleged that Sudhir Kumar and his brothers, Basanti Devi, Ramanand Paswan and others mortgaged her property and took loan from the Punjab National Bank, Mahendia Branch. It is submitted that the petitioner is the Branch Manager of the Punjab National Bank, Mahendia Branch and Mosmt. Lalmuni Devi executed the mortgage deed and she was duly identified as Lalmuni Devi wife of Late Ram Parikha Singh by Ramanand Paswan. The petitioner is not the identifier

Patna High Court Cr.Misc. No.17242 of 2016 (3) dt.15-07-2016 2/2 nor did he know the identity of Mosmt. Lalmuni Devi. The moment the petitioner came to know about the impersonation of Mosmt. Lalmuni Devi, he immediately issued notice to the mortgagor for refund of money.

Considering the facts aforesaid and the facts that the petitioner is the Branch Manager of the Bank and he did not know about the impersonation of Mosmt. Lalmuni Devi, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in Complaint Case No. 1190/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
