JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-11-2022 The present writ petition has been filed seeking the following reliefs :- i) For issuance of appropriate writ in the nature of mandamus seeking direction to Respondents to remove the encroachment which has been caused by some Anti Social element over Khata no. 255 Khesra no. 1278 having an area of 1.32 Acres situated in the mauza jankidih which is a public land acquired by government for making construction of Panchayat Bhawan but due to strong resistance of Anti social element construction work has been stopped and Respondent-Authority are not taking interest for removal of encroachment.
Patna High Court CWJC No.255 of 2022(2) dt.04-11-2022 2/2 ii) For issuance of appropriate writ in the nature of mandamus seeking direction to Respondent to give protection from encroachers who deliberately without any authority of law has put an obstruction for making construction of Panchayat Bhawan over government land which was validly acquired and petitioner is suffering irreparable loss and injury because he has collected the raw material at the site which is being damaged by the encroachers.
Considering the grievances raised by the petitioner, as aforesaid, I deem it fit and proper to relegate the petitioner to the remedy of filing appropriate representation before the leaned Collector, Lakhisarai for redressal of his aforesaid grievances. It is needless to state that in case, appropriate representation is filed by the petitioner within a period of 4 weeks from today, the same shall be considered by the learned Collector, Lakhisarai and appropriate orders shall be passed thereon, in accordance with law, within a period of 8 weeks, thereafter. The writ petition stands disposed off on the aforesaid terms.
