ANJANA MISHRA ORAL ORDER 18-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 21.04.2019 in connection with Special Case No. 3 of 2019 arising out of Khagaria P.S. Case No. 263 of 2019 for the offenses under Sections 8, 20(b)(ii) (c), 25, 29 of N.D.P.S. Act. Learned counsel for the petitioner submits that the alleged recoveries have not been verified chemically and, therefore, they cannot be said to be items listed under the NDPS Act. It is further submitted that nothing has been recovered from the physical and conscious possession of the petitioner. However, it appears that the petitioner was found to be in possession of 14.800 kgs of Ganja in a big jhola with which he was wandering around near the railway station.

Patna High Court CR. MISC. No.67908 of 2019(3) dt.18-11-2019 2/2 Considering the aforementioned facts and circumstances, I am not inclined to grant bail to the petitioner. It is, accordingly, rejected.
