The petitioner seeks bail in connection with Jhajha Rail G.R.P. P.S. Case No. 60 of 2017, registered under Section 30(a) and 38(1) of the Bihar Excise Amendment Act, 2016. The accusation is that in course of checking of the general compartment at railway station JhaJha, petitioner and one Pawan Kumar were seen near the toilet of the compartment with two bags. On search of the bag, which was with the petitioner, 18 bottles, each containing 750 ML India made foreign liquor recovered and 6 bottle, each containing, 750 ML India made foreign liquor and two cane beer recovered from the possession of co-accused Pawan Kumar.

No.28088 of 2017 (2) dt.22-06-2017 2/2 Learned counsel for the petitioner submits that, in fact, petitioner and co-accused were travelling in the general compartment and on suspicion petitioner and one Pawan Kumar were apprehended by the Police. Further submission is that petitioner is in custody since 09.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Addl. Sessions Judge-cum-Special Judge (Excise) Lakhisarai in connection with JhaJha Rail G.R.P. P.S. Case No. 60 of 2017.
