1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 308(5), 351(2), 352, 3(5) of B.N.S and 25(1-B)(a), 26, 27 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has antecedent of six cases and the informant alleges that Arshad Hussain indents to grab his land and also threatened that if you wants to keep his land then will have to pay an extortion of Rs. 5 crore, next alleges that on 26.12.2024 the informant with his friends were warming up after constructing the boundary wall, when Imran along with four accused came at 9.15 P.M on two motorcycle and started abusing and

No.63864 of 2025(2) dt.22-09-2025 2/3 demanded extortion and fired about 8-10 rounds with an intention to kill him and friends, but they were saved, however, police came and arrested four accused persons and one accused fled on motorcycle, further the apprehended accused disclosed their names as Ranjit, Sarla and Aditya and from their possession country made pistol along with cartridges and motorcycle were recovered and the apprehended accused also disclosed the name of the accused who fled.
4. Learned counsel submits that the petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR it would manifest that on account of dispute relating to land the petitioner has been falsely implicated. It is next submitted that Arshad Hussain is father of the petitioner and the land belongs to the petitioner and even Jamabandi is in the name of his father and it is the informant who intends to grab their land and thus has falsely implicated the petitioner along with his father. It is further submitted that Arshad Hussain has been granted the privileged of anticipatory bail by the learned District Court.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that the petitioner

No.63864 of 2025(2) dt.22-09-2025 3/3 has antecedent of six cases and from the place of occurrence four accused were apprehended and from their possession country made pistol along with live cartridges were recovered and the informant identified the petitioner and even the apprehend accused disclosed his name that he fled when police arrived. It is also submitted that since the petitioner has antecedent of criminal cases and if the privilege of anticipatory bail is granted, the petitioner may abscond.
6. Considering the submissions made by the learned A.P.P, this Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
7. The prayer of the petitioner for anticipatory bail stands rejected.
