The petitioner seeks bail in connection with Jeeradei P.S. Case No. 16 of 2017, registered under Sections 413, 414, 467 and 471 of the Indian Penal Code.
The accusation is that on receiving secret information about gathering of miscreants, who are trying to sell the stolen bullet, at village Bhaisakhal near bridge of Sona river. The Police reached there and saw four persons with bullet motorcycle out of which three persons succeeded to flee away, but petitioner was apprehended with the bullet motorcycle. On asking petitioner, did not produce any paper regarding ownership of the said motorcycle.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.28080 of 2017 (2) dt.22-06-2017 2/2 petitioner has no criminal antecedent and he is in custody since 14.02.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-I, Siwan in connection with Jeeradei P.S. Case No. 16 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and further the petitioner shall remain present on each and every date during the course of the trial. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
