JUSTICE BIRENDRA KUMAR ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/307/353 of the Indian Penal Code and Section 27 of the Arms Act. According to F.I.R. a group of criminals started firing at the police. The police also fired. However, no criminal was arrested at the spot.

Submission of the learned counsel for the petitioner is that the petitioner is in custody since 20.01.2016. He has been falsely implicated by the police only on the basis of some criminal cases pending against the petitioner. Considering the nature of material and the period

Patna High Court Cr.Misc. No.28276 of 2017 (2) dt.04-07-2017 2/2 already undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa/Successor Court, in connection with Mahishi P.S. Case No.124 of 2006, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
