The petitioner is in custody since 26.07.2019 in connection with G.O. Case No. 751 of 2019 arising out of Town P.S. Case No. 178 of 2019 for the offence registered under Sections 30(A) of the Bihar Excise and Prohibition Act, 2016. Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather the same has been recovered besides his scutty. It is further submitted that the petitioner has been falsely implicated in this case by one Vijay Mahto.

Considering the aforesaid facts and circumstances of the case and except one criminal antecedent, the petitioner has no other case, let the petitioner, above named, be released on
