Petitioner apprehends his arrest in a case under section 406, 409, 420, 120(B) of the Indian Penal Code. Prosecution story is that the petitioner along with the proprietor of Raiganj Good Grain Pvt. Ltd, executed an agreement for Kharif marketing for the year 2012-13. As per the agreement, the proprietor of rice mill received 832.74 M.T. rice from S.F.C. and the mill had to provide 67% of paddy i.e. 557.94 M.T. Custom Milled Rice to the S.F.C. It is alleged that the said mill had not supplied Custom Milled Rice and misappropriated 557.94 M.T. rice worth Rs.1,20,82,525.46/-.
Patna High Court Cr.Misc. No.19491 of 2016 (2) dt.08-06-2016 2/2 Having regard to the nature of allegations, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is refused with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice, preferably on the same day.
