JUSTICE VIKASH JAIN ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 23-02-2015 This writ petition has been filed seeking a direction to the Respondent authorities to get the matter pertaining to installation of Solar lights, and the distribution of amounts under the Indira Aawas Yojna in Block Dawat, District Rohtas, investigated through some independent agency, such as Central Bureau of Investigation or the Vigilance Department.

2. General allegations have been made in the writ petition with regard to irregularities said to have been committed at various levels resulting in defalcation of huge amounts of

Patna High Court CWJC No.22239 of 2013 dt.23-02-2015 public money in the matter of installation of Solar lights and the construction of houses for the homeless under the Indira Aawas Yojna.

3. Heard Sri Krishna Kant Singh, learned counsel for the petitioner and the learned Additional Advocate General-10 for the Respondents.

4. With regard to Solar lights it has been stated that quotations from M/s. Kamlesh Electricals, Chandni Chowk, Fraser Road, Patna and M/s. Electric Corner, Fraser Road, Patna were approved and supplies were obtained from them, whereas upon enquiry by the petitioner, such quotations were found to be non-existent.

5. It has also been stated in the petition that distribution under the Indira Aawas Yojna is not being made fairly and properly to the needy persons. However, he did not furnish any specific details, in this regard.

6. Be that as it may, the petitioner has already filed a representation in this regard before the Hon'ble Chief Minister of Bihar with copies thereof to the various authorities, as contained in Annexure-5 to the writ petition.

7. Taking the overall view of the matter, therefore, this Court is of the view that the ends of justice will be met if the Respondents are required to dispose of the aforesaid representation of the petitioner, expeditiously, preferably within

Patna High Court CWJC No.22239 of 2013 dt.23-02-2015 a period of three months from the date of receipt/production of a copy of this order.

8. The writ petition accordingly disposed of with the above observations.
