JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioner, who is husband, apprehends his arrest in relation to Sasaram (Model) P.S. Case No. 376 of 2014 registered under Sections 341, 323, 504, 498(A), 379, 34 of the Indian Penal Code by his estranged wife.
Learned counsel for the informant has been heard.
Learned counsel for the petitioner first points out that the marriage between the parties had taken place in the year 2002 i.e. over 13 years back. Now, an allegation of demand of dowry is being made. They already have a child of about 11 years old. Learned counsel for the petitioner further points out that first on 08.02.2014, a similar application was filed by the wife, in which, on 27.03.2014, in presence of the wife upon compromise and upon stating that there was no further complain, petitioner was allowed anticipatory bail by the
Patna High Court Cr.Misc. No.18260 of 2015 (2) dt.11-06-2015 - 2 - court below itself. The present First Information Report has been lodged on 03.05.2014 alleging that on 01.03.2014 she has been thrown out of the house which shows the falsity. Inasmuch as if, on 01.03.2014, she had been thrown out of the house, she would not have compromised the matter in court on 27.03.2014. The true reason is otherwise.
Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Ajit Kumar Singh @ Guddu Singh, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Model) P.S. Case No. 376 of 2014, subject to conditions laid down under Section 438
(2) of the Code of Criminal Procedure.
