2. The petitioner apprehends his arrest in connection with Kako P.S Case No. 29 of 2025 for the offence registered under sections 96 of the B.N.S and Sections 8 and 12 of the POCSO Act lodged on 07.02.2025 by the informant.

3. As per the prosecution story, on 07.02.2025, the daughter of the informant went to school and they failed to locate her. This led to the FIR.

4. Police investigation took place the girl was recovered and she made statement under Section 183 of B.N.S.S that fed up with the attitude of the parents, she went on her own to Parayag Raj, stayed alone in the mela and upon return, came to know that a case has been lodged.

Though learned counsel for the informant tried to show this court the medical report, in view of the fact that the girl has not alleged anything, not even whispered against the petitioner and her statement is that she went on her own and returned later, the petitioner is 21 years old student having no criminal antecedent, in that background, this Court is inclined to grant him the anticipatory bail with conditions.

Let the petitioner in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional and Session Judge6-cum-Special Judge(POCSO), Jehanabad in connection with Kako P.S Case No. 29 of 2025, subject to the following conditions. (i) one of the bailor should be the family members/relatives of the petitioner, who shall provide official document to show his bona fide.

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the trial court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail

(iv) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of the bail bonds. (Rajiv Roy, J) vashudha/- U T
