The petitioner is apprehending his arrest in connection with Mansi P.S. Case No.255 of 2014 for allegedly having committed the offence under Sections 25(1-AA), 26(1), 30 and 35 of the Arms Act.
Learned counsel for the petitioner submits that admittedly, as per the F.I.R., there is no recovery from the petitioner; rather the said allegation is against one Bhavesh Yadav. It is further submitted that the petitioner has no criminal antecedents.
Considering the aforementioned submissions and also that there is no recovery from the petitioner, let the
Patna High Court Cr.Misc. No.18510 of 2015 (4) dt.12-08-2015 2/2 petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No.255 of 2014 (G.R. No.2895 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
