The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 354 of the Indian Penal Code.

The prosecution case is that the petitioner lift dupatta of the minor daughter of the informant. It is submitted by learned counsel for the petitioner that even assuming the accusation no offence under Section 354 IPC is made out as there was no accusation that the petitioner commit the offence with intention to outrage the modesty of the daughter of the informant.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.16902 of 2016 (2) dt.21-04-2016 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Byepass P.S. Case No. 163 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Patna City.
