Petitioners apprehend their arrest in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, these petitioners along with co-accused, Ajeet Kumar pressed the neck of grand father of informant due to which he died.
Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is further submitted that the post mortem report
Patna High Court CR. MISC. No.1045 of 2022(3) dt.01-09-2022 2/2 shows that no external injury was found on the deceased and death is due to cardio respiratory failure.
Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that there is direct and specific allegation against these petitioner that they along with co-accused, Ajeet Kumar pressed the neck of grand father of informant due to which he died.
Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
