The petitioner apprehends his arrest in connection with Aurangabad Town P.S. Case No. 86 of 2011 registered for the offences punishable under Sections 406, 420, 467, 468 and 120-B of the Indian Penal Code.
Learned counsel for the petitioner submits that series of cases have been filed against the petitioner as Director of Company, namely OCPL. It is further submitted that petitioner is one of the Directors, who had started seeking information regarding the deposit fee, made in favour of the OCPL Company, money of which had been accepted by the said officers at various points of time. It is further submitted that the petitioner has started hauling up its employees at Aurangabad and therefore, the employees, who are responsible
Patna High Court Cr.Misc. No.18970 of 2015 (4) dt.18-09-2015 for misappropriation of the money, accepted by them from the depositors lodged various cases against the petitioner. It is further submitted that claims amount of the depositors are being enquired into by the company, as the present company is a responsible organization, having its head office at Kolkata. It is further submitted that taking into consideration such facts and circumstances, petitioner has been extended the benefit of anticipatory bail by different Benches of this Court vide order dated 12.08.2015 passed in Cr. Misc. No. 16064 of 2015 and Cr. Misc. No. 11197 of 2015.
In view of such facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 86 of 2011, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
