The petitioner seeks bail in GRPS Gaya P.S. case No. 78 of 2017 under Section 414 of the Indian Penal Code. The petitioner was apprehended by the police and from his possession mobiles were recovered.

It is submitted that no case for theft was registered. The mobiles belong to the petitioner. The petitioner is in jail since 26.03.2017. The petitioner has remained in jail for more than three months and he has got no criminal antecedent, as stated in paragraph 3 of the bail petition.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.29207 of 2017 (2) dt.05-07-2017 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Gaya in GRPS Gaya P.S. Case No. 78 of 2017.
