The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition Excise Amendment Act, 2018. It is a case of recovery of liquor from a Bathan of coaccused Suresh Rai. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not been apprehended at the spot and nothing has been recovered from the conscious or constructive possession of the petitioner. Petitioner has got clean

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Excise Judge, Gopalganj in connection with Baikunthpur P.S. Case No. 317 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
