The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 32(iii) and 41(i) of the Bihar Prohibition and Excise Act, 2016. It is a case of recovery of liquor from the joint house of co-accused Jagarnath and Nanhak.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not been apprehended at the spot and nothing has been recovered from the conscious or constructive possession of the petitioner. Petitioner has got clean antecedent.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Court, Vaishali in connection with Lalganj P.S. Case No. 448 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
