JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 10-05-2016 Heard counsel for the petitioner and Mr. Shailendra Kumar Singh for the respondent Bihar State Food and Civil Supplies Corporation Limited ( for short 'the Corporation'). With the consent of the parties, the writ application is disposed of at this stage.

The husband of the petitioner was serving as Peon in the Corporation and while he was posted as such at Kishanganj, the husband died in harness on 14.08.2013. None of

Patna High Court CWJC No.6607 of 2015 (2) dt.10-05-2016 2/2 the retiral dues payable to the petitioner upon death of the employee including the pension under the Scheme has been paid to her. The petitioner is in a pitiable condition and requires money. The counsel for the respondent-Corporation states that few formalities are to be completed by the employee or the claimant to enable the Corporation to forward the application for payment of the EPF amount as well as the pension, if payable, under EPF Scheme. So far as the other dues are concerned, if the petitioner appears before the District Manager (respondent no.6) and cooperate in completing the formalities within three days of her appearance the other admitted dues of the petitioner shall be sanctioned.

Considering the above, the application stands disposed of permitting the petitioner to approach the respondent District Manager of the Corporation and complete the formalities as required of her whereafter the District Manager will ensure that all admissible dues of the petitioner are paid as quickly as possible preferably within 04 weeks of such completion of formalities and the records are forwarded for payment of family pension under the EPF Scheme, if any.
