ANJANA MISHRA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Jay Nagar P.S. Case No. 183 of 2015 for the offences registered under Sections 323, 324, 326, 307, 337, 427 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner alleged to have fired on Rajdeo Yadav but there is no injury report of Rajdeo Yadav on record.
Learned counsel appearing on behalf of the State after perusal of the case dairy affirms the said situation and submitted that in the counter case, the said Rajdeo Yadav was taken into custody and there is no report regarding him having received any such injuries.
Patna High Court Cr.Misc. No.19987 of 2016 (3) dt.01-09-2016 Considering the aforesaid facts and circumstances of the case and also the fact the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Madhubani , in connection with Jay Nagar P.S. Case No. 183 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
