Petitioner is seeking bail in a case registered under Sections 272, 273 of Indian Penal Code and Section 30 (a) of Bihar Prohibition & Excise Act, 2016.

It is submitted on behalf of the petitioner that the instant case arises out of seizure of liquor. The petitioner, as per allegations made in the first information report, is only a Khalasi of the vehicle and has no concern with the seized articles. His further submission is that he has got no criminal antecedent and there is no compliance of the provisions of Section 100 of Criminal Procedure Code. Further submission is that similarly

Patna High Court Cr.Misc. No.28514 of 2017 (2) dt.01-07-2017 2/2 situated co-accused has been granted bail by order dated 23.05.2017 passed in Cr Misc No 23273 of 2017. Considering the aforesaid facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II, Sitamarhi in Sitamarhi (Mehsaul OP) Police Station Case No 87 of 2017.
