2. Learned counsel for the petitioner submits that through sheer inadvertence, the respondent no. 5 was erroneously described as "the Executive Engineer, Building Construction Division, Ara" in the array of parties instead of "the Executive Engineer, Building Construction Division, Buxar", as a result of which the same error was carried in the judgment of this Court dated 14.01.2016.

3. In the above view of the matter, let para 4 of the judgment

Patna High Court MJC No.1804 of 2016 (2) dt.10-08-2016 dated 14.01.2016 passed in CWJC No. 5783 of 2014 be treated as modified only to the extent that the words "the Executive Engineer, Building Construction Division, Buxar (Respondent no. 5)" shall be read in place of the words "the Executive Engineer, Building Construction Division, Ara (Respondent No. 5)".

4. M.J.C. No. 1804 of 2016 stands allowed.
