The petitioners apprehend their arrest in connection with Narpatganj P.S. Case No. 451 of 2014 registered for the offences punishable under Sections 467, 468, 471, 420, 406, 409/34 of the Indian Penal Code. The allegation is that the petitioners had not completed their work orders as because, the solar lights which
Patna High Court Cr.Misc. No.20069 of 2015 (5) dt.24-09-2015 were to be installed, had not been installed, within the stipulated time, given by the authorities.
Learned counsel for the State has filed counter affidavit, stating therein that soon after filing of the First Information Report, the petitioners have completed their work orders and thereafter, Director D.R.D.A. Araria, E.E. Manrega , Araria visited the sites and found that the work under scheme was physically completed and accordingly, verification report was sent to the D.M. Araria.
In view of the fair stand taken in the counter affidavit by the opposite party-State and since the work for which, first information has been instituted had been completed, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Araria in connection with Narpatganj P.S. Case No. 451 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
