This is a case registered under Sections 147, 149, 341, 323, 324, 307, 504 of the Indian Penal Code. The allegation against the petitioner is that he along with four other persons named in the FIR came to the field of the informant and committed assault.
Counsel for the petitioner submits that in fact it is the petitioner and his son who sustained injury on account of assault by the informant side for which Nokha P.S. Case No. 183 of 2016 was instituted under Sections 147,149,323 and 307 of the IPC and after manufacturing injury report, the instant FIR has been lodged as counter blast. The petitioner has no criminal antecedent prior to the instant case and he is in custody since
Patna High Court Cr.Misc. No.28764 of 2017 (2) dt.01-07-2017 2/2 01.05.2017.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Rohtas at Sasaram in Nokha P.S.
