====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 22-03-2025 Heard Mr. Anupa Nand Jha, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Kajraili P.S. Case No. 44 of 2024 registered for the offence punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
3. As per the allegation made in the F.I.R., petitioner was selected on the post of Anganwari Sevika on the basis of forged certificate.
4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner was not aware of the certificate which was submitted at the time of selection and once the certificate has been found to be forged, the petitioner has been terminated from service of Anganwari Sevika. Petitioner is a lady and she has suffered. Action has been taken against her
Patna High Court CR. MISC. No.66808 of 2024(4) dt.22-03-2025 2/2 by the appropriate authority. In that view, the petitioner deserves to be released on bail.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.
6. Considering the nature of allegation against the petitioner that she got selected as Anganwari Sevika on the basis of forged certificate and it is not unknown that such forgery is prevalent in the State of Bihar, an F.I.R. was lodged once it was detected that the petitioner's certificate is forged, petitioner has been terminated from service and action has already been initiated against the petitioner by the appropriate authority, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of her arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Kajraili P.S. Case No. 44 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
7. The bail application stands disposed of.
