JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-08-2022 Though the present writ petition has been filed to direct the respondents to remove the encroachment from Plot no. 164 under Khata no. 49 of Mauza-Meraripur under Kargahar Anchal, Rohtas, however the learned counsel for the petitioner has confined his relief to grant of liberty to the petitioner to approach the respondent no. 5 i.e. the Circle Officer, Kargahar, Rohtas for removal of the encroachment in question. Accordingly, the present writ petition stands disposed off, however with liberty to the petitioner to approach the respondent no. 5 by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956

Patna High Court CWJC No.6955 of 2018(3) dt.08-08-2022 2/2 and in case, such an application is filed within a period of four weeks from today, the respondent no. 5 shall consider the same in accordance with law and after hearing the affected parties, shall pass final order, within a period of twelve weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
