Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 353, 307/34 of the Indian Penal Code, 27 of the Arms Act and 3/4 of the Explosive Substance Act.
It is alleged that the accused persons made indiscriminate firing on the police force and in retaliation police force also fired. On chase co-accused Binda Awadhia and Guddu Kumar were apprehended, arms were recovered from their possession and they disclosed the name of the petitioner and others. The police personnels also received injury.
It is submitted by the learned counsel for the petitioner that petitioner has only been roped in this case since
Patna High Court Cr.Misc. No.19605 of 2015 (2) dt.29-04-2015 the father of the petitioner has criminal record. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gopalganj Town P.S. Case No. 317 of 2014, pending in the court of learned Chief Judicial Magistrate, Gopalganj. With this observation this application is disposed of.
