Sri Sanjay Kumar, learned Standing Counsel for the C.B.I. submits that the appellant preferred an appeal against both orders i.e. order passed in the present case, whereby restoration petition was dismissed due to non-prosecution. Thereafter one another restoration petition was also filed, which was dismissed on merit. Thereafter, the petitioner preferred an appeal before the Supreme Court and the Hon'ble Supreme Court has disposed of the appeal permitting the petitioner to approach this Court and plead for grant of anticipatory bail on the foundation of parity. The petitioner has filed a fresh anticipatory bail petition vide Cr.Misc.No.22899 of 2017 in the light of the order

Patna High Court Cr.Misc. No.19709 of 2016 (4) dt.05-07-2017 2/2 of the Hon'ble Supreme Court.
