JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of D.G. Vigilance, Patna. The petitioner apprehends his arrest in connection with Special Case no. 42 of 2016 (Vigilance P.S. Case No.100 of 2016), registered under Sections 420, 467, 468, 471, 472, 477-A, 409 and 120-B of the Indian Penal Code and Section 13(2), 12(1)(d) of the P.C. Act.

The accusation is that Rs. 248100/- as grant in aid was received for the session 2007-2010 by "Desh Ratna Rajendra College, Jiradai, Siwan" and the said amount was distributed between teaching and non-teaching staffs out of which some were not appointed legally under the conspiracy of the college management committee. Learned counsel for the petitioner submits that petitioner

Patna High Court Cr.Misc. No.28616 of 2017 (4) dt.13-09-2017 2/2 is the Secretary of the Managing Committee and only allegation is distributing grant in aid in teaching and non-teaching staffs out of which some were not legally appointed. There is no allegation of misappropriation of the said money by this petitioner being the Secretary of the Managing Committee.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance, North Bihar, Muzaffarpur in connection with Special Case No. 42 of 2016 (Vigilance P.S. Case No. 100 of 2016), subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
